At the design of whole Public Accusation we gave as an example the Legal Reform when it has been done to unite the functioning of the prosecution services of England and Walles in 1980 (Crown Prosecution Service). As we have been devclaring before, the corner stone of the new legislative solution that may lead to the maximalization of the role of the prosecutors in the criminal proceedings were the prosecutor is conducting the indipendent investigation in cases of serious corruption, we can find, as an example in the decisions of the lawmakers in US where they established the Criminal Division’s Public Inegrity Section. The design modifications of the Public Accusation should be made under the influence of the Aanglo-American System of Law. Public Prosecution has no monopoly on justice, honesty and fairness to be the arbiter in society upon that, but in contrary, the Public Prosecution has to be organized as the equal party in proceedings.
Justice imagined as equality, possibility and willpower to sensibillizing the position of the other party and according to that to proceed by Golden Rule that says: each proceeding you may have done can be repeated to you.
The second issue is that in the modern Criminal Procedure Law the equal importance has been setup for the Legality Principle and to the Legitimacy Principle. A improvement of the organization of the Public Accusation in the form of Public Prosecution is of the high importance for efficent combating ti corruption and all other serious crimes.The first issue on the organization of the public prosecution that charcterize the new design of the Public Accusaion is the Accusatory Principle of the Criminal Procedure Code, as the key principle of the procedural actions done before the court and thus influencing the whole construction of the prosecution service.
